TIC Recruitment – Terms and Conditions for Teacher Users

Jurisdiction: New Zealand

By registering and subscribing to TIC Recruitment’s online recruitment and job platform (“Platform”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you may not register or use the Platform.


1. Introduction

1.1 TIC Recruitment provides an online service connecting qualified teachers (“Candidates”) with international schools (“Schools”) seeking teaching staff.

1.2 These Terms and Conditions govern your use of the Platform, including access to job listings, applications, subscriptions, and related services.

1.3 TIC Recruitment may update these Terms and Conditions from time to time. Users will be notified of significant changes. Continued use of the Platform constitutes acceptance of updated terms.


2. Eligibility

2.1 To register as a Candidate, you must:

  • Be at least 18 years of age.
  • Hold a recognised teaching qualification from an accredited or recognised tertiary institution.

2.2 By registering, you confirm that you meet these requirements and can provide proof if requested.


3. Registration and Accounts

3.1 Candidate Accounts

a) Candidates must provide accurate, current, and complete information, including qualifications, registrations, employment history, and referees.

b) Candidates are responsible for maintaining the accuracy of their profiles and for keeping login credentials secure.

c) Candidates are responsible for all activity that occurs under their account and must notify TIC Recruitment immediately of any unauthorised use.

d) Candidates must comply with all applicable safeguarding and child protection requirements relevant to teaching roles.

e) Candidates are encouraged to engage in professional development and training related to safeguarding and international teaching standards.

3.2 School Accounts

a) Schools must ensure all information provided about vacancies, roles, and employment conditions is accurate, lawful, and compliant with employment, immigration, safeguarding, and anti-discrimination laws in their jurisdiction.

b) TIC Recruitment does not guarantee the accuracy, completeness, or legality of School-provided information.


4. Subscriptions and Payments

4.1 Access to certain Platform features may require a paid subscription.

4.2 Subscription fees, payment methods, and renewal terms are displayed at registration and in your account settings.

4.3 All subscription fees are thirty Great British Pounds (£30) unless otherwise stated. TIC Recruitment reserves the right to change the subscription fee at any time.

4.4 TIC Recruitment reserves the right to suspend or terminate accounts for non-payment or breach of these Terms.

4.5 No refunds are guaranteed except as required under New Zealand consumer law.

4.6 Unsubscribing / Cancelling Your Account

a) Candidates may cancel their subscription or account at any time through their account settings or by contacting TIC Recruitment.

b) Upon cancellation, access to subscription-only features will end immediately, but TIC Recruitment may retain your personal data as required by law or for operational purposes.

c) Cancellation does not automatically entitle the Candidate to a refund, except where required by New Zealand consumer law or if specified in the subscription terms.

d) Candidates who unsubscribe may re-register or reactivate their account at any time, subject to current Terms and Conditions.


5. Confidentiality, Privacy & Data Protection

5.1 TIC Recruitment collects, stores, uses, and discloses personal information in accordance with the New Zealand Privacy Act 2020 and our Privacy Policy.

5.2 Candidate data is held securely and confidentially. Reasonable technical and organisational safeguards protect personal information from loss, misuse, unauthorised access, or disclosure.

5.3 Candidate information will only be shared with Schools where:

  • The Candidate has applied for a Role; and
  • The Candidate is being actively considered or shortlisted for that Role.

5.4 TIC Recruitment does not sell Candidate data or disclose it to third parties for unrelated marketing purposes.

5.5 Candidates have the right to request access, correction, or deletion of personal information, subject to legal and operational requirements under the Privacy Act 2020.

5.6 By registering, Candidates consent to receive communications regarding job opportunities, Platform updates, newsletters, and other electronic communications.

5.7 TIC Recruitment may retain Candidate data for operational, legal, or regulatory reasons, even after account cancellation, as further detailed in our Privacy Policy.


6. Intellectual Property

6.1 All Platform content, including logos, job postings, branding, and materials, is owned by TIC Recruitment or used under licence.

6.2 Users may not copy, reproduce, distribute, or commercially exploit any Platform content without written permission.


7. Prohibited Conduct

Candidates and Schools must not:

a) Misrepresent qualifications, experience, or job information.
b) Engage in harassment, discrimination, or offensive behavior.
c) Share other users’ personal data without consent.
d) Use the Platform for unlawful purposes.
e) Take any action that may bring TIC Recruitment or another User into disrepute.


8. Relationship Between Users

8.1 Any employment relationship, offer, appointment, or engagement is strictly between the Candidate and the School.

8.2 TIC Recruitment is not responsible for negotiations, contracts, salaries, benefits, visas, relocation arrangements, or workplace conditions.

8.3 Candidates applying to work internationally acknowledge that TIC Recruitment is not responsible for visas, immigration, taxes, employment rights, or compliance with laws in other countries.


9. Limitation of Liability

9.1 The Platform is provided on an “as is” basis. TIC Recruitment does not guarantee employment or success in securing roles.

9.2 TIC Recruitment is not liable for indirect, incidental, or consequential losses arising from use of the Platform or interactions with other Users.

9.3 Nothing in these Terms excludes or limits liability to the extent prohibited by New Zealand law.


10. Force Majeure

TIC Recruitment is not liable for any delay, disruption, or failure to provide the Platform resulting from events beyond its reasonable control, including but not limited to natural disasters, internet outages, government restrictions, or technical failures.


11. Platform Changes

TIC Recruitment may modify, suspend, or discontinue parts of the Platform at any time without notice. Users agree that TIC Recruitment is not liable for any modification, suspension, or discontinuation of Platform features.


12. Termination

12.1 TIC Recruitment may suspend or terminate accounts for breach of these Terms, inactivity, or at our discretion.

12.2 Upon termination, Users remain liable for any outstanding fees and obligations incurred prior to termination.

12.3 TIC Recruitment may retain Candidate information as required for legal, regulatory, or operational purposes.


13. Dispute Resolution

13.1 Users agree to attempt informal resolution of disputes with TIC Recruitment before escalating to legal proceedings.

13.2 Where informal resolution is unsuccessful, disputes will be subject to the exclusive jurisdiction of New Zealand courts.


14. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.


15. Governing Law

These Terms and Conditions are governed by the laws of New Zealand.


16. Acceptance

By registering on the Platform, you confirm that you:

  • Have read, understood, and agree to these Terms and Conditions.
  • Consent to the collection, storage, and use of your personal information as described above.
  • Acknowledge that if you are offered employment, this is solely with the School and not TIC Recruitment.
  • Agree to comply with all applicable laws, safeguarding requirements, and professional conduct expectations.
